Right of First Refusal Properties
The Right of First Refusal (RFR) is a mechanism within the Waikato Raupatu Claims Settlement Act 1995. It gives Waikato-Tainui the first opportunity to purchase Crown-owned land, within our rohe, that has become surplus to Crown requirements.
As part of the Crown's disposal (sale) process, properties that are subject to RFR must be offered to Waikato-Tainui to purchase in the first instance.
Note: Not all Crown owned property is subject to RFR.
The Opportunity
- Waikato-Tainui has opted to purchase a number of ex-Kaainga Ora properties that will be immediately on-sold to tribal members at the same price they were acquired for.
- All properties are being sold as-is, where-is condition
- Advertised prices are fixed. No further negotiations will be entered into if an offer is submitted below the listed price.
- Purchasers are required to undertake their own due diligence at their own cost.
- All properties are being sold via Deadline Sale.

Details of available properties are published on this page and shared to tribal members via e-paanui and Waikato-Tainui social platforms.
Expression of Interest (EOI)
Complete the EOI form to obtain additional information and about the property you are interested in purchasing. Please note, to complete the EOI, you will need the following information:
- Tribal Registration Number
- RFR Property ID
Review Documentation
Once you have submitted your EOI, you will be sent a link to view additional documentation and information for you to complete your due diligence.
Making an Offer
All offers will need to be presented on the Agreement for Sale and Purchase provided in the property folder that you can access once you have submitted your expression of interest. Those offers need to be presented before the advertised Deadline Date by email to rfrproperties@tainui.co.nz You are responsible for seeking independent legal advice, including costs associated.
Deadline Date
All offers must be received prior to 11:59pm on the Deadline Date. Offers received after the Deadline will not be considered.
You will be notified within 7 business days after the close date as to whether your offer has been accepted, rejected or there are negotiations that need to be discussed.
Conditional and Unconditional
You will have an agreed fixed period to satisfy the conditions that have been listed on the Sales and Purchase Agreement.
Once the fixed period ends and all conditions are satisfied, you will enter into what is known as the Unconditional period. This is a fixed period before Settlement takes place.
Settlement
Settlement date is agreed when your formal offer is accepted. Your legal representative will notify you once Settlement has been completed and you can collect keys to your whare.

The first step is for you to complete an Expression of Interest (EOI) so that we know you are interested and we have all your contact details. Once a viewing has been scheduled, you will be contacted directly. All parties interested in purchasing the property will be invited to the same viewing. Viewings will be carried out by Waikato-Tainui kaimahi.

If you are a first home buyer, we suggest engaging the support of a Mortgage Broker who will be able to assist you throughout the entire purchasing process, including obtaining lending. We also encourage you to seek independent legal advice.
No. Waikato-Tainui will not provide a grant or any other financial assistance towards your purchase.
No. All RFR properties available are being sold via the traditional sale method. This means, prospective purchasers are required to have a deposit and apply for lending from a bank or other financial institution in order to complete the purchase.
No. Prices are fixed and non-negotiable. The price for you to purchase the property, is the same price that Waikato-Tainui has purchased the property. No further negotiations will be entered into if an offer is submitted below the listed price.
If we do not receive any Expressions of Interest or formal offers before the Deadline date, the properties will be sold on the open market. This means that members of the public, will have an opportunity to make an offer. Tribal members can still submit an offer when a property is on the open market.
All offers will be reviewed, and one will be selected by a panel to proceed with the purchase. Your offer will be accepted, rejected or we will contact you to negotiate conditions or dates. If the selected purchaser is unable to proceed, the property will be offered to one of the other purchasers.
No, Deadline Sale. Expressions of Interest (EOIs) are reviewed in order of submission, but final selection depends on the formal offers that are received prior to the Deadline date.
All formal offers must be submitted on a Sales and Purchase Agreement. After the deadline date, all formal offers are reviewed. You will be notified and advised if your offer has been accepted, rejected or further negotiations are required.
Yes. Please list any applicable conditions on the formal offer that you make on the Sales and Purchase Agreement. We strongly recommend you seek legal advice prior to submitting a formal offer. Note: You are responsible for the costs associated to engaging a legal professional to review documents or provide you with advice.

Expression of Interests – Open for 3 weeks

It is anticipated that the current release of properties will settle by late January or early February 2026.
We encourage you to review the Property profiles to identify the property you are interested in purchasing. You will need the RFR Property ID for the Expression of Interest form. If you are interested in more than one property, you will need to submit multiple EOI's. The EOI only allows for one property to be selected.
A non-tribal member can be included in the purchase if the primary applicant is a registered tribal member and both parties intend to live in the home.
No. Unless the nominated party is a Tribal Member, purchasers will not be permitted to designate a third party to take their place in completing the purchase.
Once you purchase your RFR home, you become the registered property owner and it becomes your legal property. Waikato-Tainui does not provide direct assistance beyond this point. However, as a tribal member, you may still be eligible to apply for future housing initiatives such as the Home Repairs Programme or other housing-related kaupapa.
